Madrid Protocol extends to NZ and Mexico
Mexico is the latest nation to join the Madrid Protocol – the international trade mark system.
The news, which was announced by the World Intellectual Property Organisation (WIPO) in Geneva, Switzerland, will see Mexico’s membership come into force in February next year.
“Brand owners in Mexico stand to greatly benefit from the Madrid Protocol,” said Bruno Ferrari, Mexico’s secretary of economy. He observed that with one of the world’s largest networks of trade agreements, Mexico will continue to expand its exports of products – including technology – to other countries.
“Since this extended network of trade agreements includes many Latin American countries, Mexico trusts that many more countries of the region will soon join this very useful tool; particularly, as a means to foster regional and global economic growth, as it has been promoted by Mexico during its G-20 Presidency in 2012,” Ferrari said.
New Zealand took similar steps earlier this Spring, with the Madrid Protocol entered into force in New Zealand on 10 December 2012. Under the new arrangements, New Zealand trade mark owners can file a single application with IPONZ – the Intellectual Property Office of New Zealand – designating one or more member countries where they would like to seek trade mark protection. Australian trade mark owners can equally now easily extend the protection of their marks to New Zealand by filing an international trade mark application designating New Zealand under the Madrid Protocol.
In addition to New Zealand and Mexico, Colombia and the Philippines joined the Madrid Protocol during 2012. There are now a total of 89 member nations participating in the international trade mark system – and Mexico’s membership marks the fourth Spanish-speaking country to join the agreement.
According to WIPO, small and medium-size enterprises are the largest users of the Madrid Protocol. In 2011, a total of 42,270 trade mark applications were made under the system.
